Terms and Conditions of Service!   

The use of hosting services from VBHOSTNET constitutes an agreement by the customer to the terms and condition outlined below:

Privacy Policy

1. New Account Setup

All new web hosting and resellers/master account are only setup instantly when payments claims have been verified. Thus, it is your responsibility to provide a valid email address that is different from the domain/web site you are intending to setup in which your web site details will be sent to when your account is now activated. Providing false contact information of any kind may result in the termination of your account with no refund.

VBHOSTNET has a very strict & comprehensive accounts verification process. All new sign-ups are put through this very stringent mechanism. Accounts are then processed & forwarded for hosting once the genuinity of the signup is established. Under no circumstances would new accounts be setup without verifying the authenticity of your payment claim. VBHOSTNET would not be responsible for delayed account setups in cases where customers payment have not been verified as claimed.

2. Contents

VBHOSTNET believes in freedom of contents BUT will in no means tolerate the contents that contain the listed format. All contents must be for lawful purpose only and not violating copyright laws:

We do not allow and give zero tolerance to abusive contents or content that promotes war, racism, creed, or belief; profanity or obscene language towards anyone; any violent/malicious content. Pornography/adult content are strictly prohibited. VBHOSTNET hosted site are not allow to upload contents that has IRC Bots, Pirated Software / Warez, image, filedump, or banner-ad services (similar to rapidshare, photobucket, or commercial banner ad rotation), topsites, locally hosted chat scripts, Escrow, Fake Bank site or High-Yield Interest Programs (HYIP), lottery sites, Pornographic Sites, muds / rpg's, hate sites, hacker focused sites/archives/programs, or sites promoting illegal activities, IP Scanners, Brute Force Programs, Mail Bombers and Spam Scripts.

We do not allow Web Proxy Services / Scripts or file hosting services on our Server. No remote uploading/processing scripts usage like rapidleech, Phpmusicsearch, rapidshare premium link generator etc etc are not allowed in our server. Torrent seeding using torrentflux or similar script may also cause a suspension in our network immediately.

You can't offer free hosting, its totally prohibited if found your account will be suspended or terminated with or without notice. You can't use hosting for filesharing scripts or file hosting purpose.

Multimedia  Content (video, Audio, Mass Image Album)

You are also not allowed to host an Image Hosting site with us which takes lots of CPU resources and abuse the server memory. Video and Audio streaming/sharing is not allowed as well. If in this case you wish to utilize multimedia features, the option here is to upload video/audio file to a site like www.agilevids.com (Video sharing site, mp3 and photos) after which, you can embedded such file into your web pages without causing any harm.

Chat Rooms
VBHOSTNET does not provide nor allow chat rooms on shared hosting environments. If you wish to do so, you can contact [email protected] for Virtual Server preparation.
 

3. Backups

Your use of the service is at your sole risk. VBHOSTNET shall not responsible for files and data residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on our servers

4. Refunds

All payments to VBHOSTNET are nonrefundable except otherwise money back guarantee (7 Days) is provided, Domain Registration fee are not refundable. This includes any setup fees and Periodic fees regardless of usage.

Note: For any refund to be initiated, there should be a valid reason for requesting a refund which must be done through email.

5. Resource Abuse Policy (RAP)

a. What "Unlimited" means. VBHOSTNET does not set an arbitrary limit or cap on the amount of resources on most hosting packages. In good faith and subject to these Terms, VBHOSTNET makes every commercially reasonable effort to provide its Subscribers with all the storage and bandwidth resources needed to power their web sites successfully, as long as the Subscriber's use of the service complies with these Terms. By not setting limits on key resources, we are able to provide simple, consistent pricing to our Subscribers as they grow their websites. As a result, a typical website may experience periods of great popularity and resulting increased storage without experiencing any associated increase in hosting charges.

b. What "Unlimited" DOES NOT mean. VBHOSTNET employs complex mechanisms to protect its Subscribers and systems from abuse. VBHOSTNET offering of "unlimited" services is not intended to allow the actions of a single or few Subscribers to unfairly or adversely impact the experience of other Subscribers.

VBHOSTNET is a shared hosting service, which means that multiple Subscriber web sites are hosted from the same server and share server resources. VBHOSTNET service is designed to meet the typical needs of small and media size business web site as well as home business website Subscribers. It is NOT intended to support the sustained demand of large enterprises  or non-typical applications better suited to a dedicated server or Virtual sever.

Any activity that results in excessive usage that is inconsistent with normal usage patterns is strictly prohibited and may result in account suspension or termination.

 c. AVERAGE SERVER RESOURCE LIMITS

• Memory usage may not exceed 10% per domain/file/application. these include: CGI scripts, FTP, PHP, HTTP, etc.

• CPU usage may not exceed 20% per domain/file/application, these include: CGI scripts, FTP, PHP, HTTP, etc.

• Apache connections may not exceed 30 connections

• 15 MySQL maximum user connections allowed

• 50 emails per hour, per domain

• Run stand-alone, unattended server-side processes at any point in time on the server. This includes any and all daemons, such as IRCD.

• Run any type of web spider or indexer (including Google Cash / AdSpy) on shared servers.

• Run any software that interfaces with an IRC (Internet Relay Chat) network.

• Run any bit torrent application, tracker, or client. Please note that you may link to torrents off server, but may not host or store them.

• Participate in any file-sharing/peer-to-peer activities.

• Run any gaming servers such as counter-strike, half-life, battlefield1942, etc.

• Run cron entries with intervals of less than 15 minutes.

6. Billing

Late Payments
All hosting accounts have to be renewed early as per the respective billing cycles. This which should be done Five (5) day before due date. In order to prevent loosing your domain name and account suspension/termination after the said duration. When you hosting account approaches expiration, you will receive a notification to that effect. Please note that VBHOSTNET holds the right to deny access to and/or de-activate accounts hosted on our servers that has not renewed his/her services.

Accounts are at risk for suspension of service if payment for hosting is not received 5 days after the due date. and May be at even more risk of loosing domain totally from the domain registrar end because without payment domain name cannot be renewed hence we it is advice payment is made before expiration.

Note: Late payment after five (5) days of grace may attract re-activation fee.

FREE Domain Name

Domain names are free for all hosting package, however, to continue enjoying free domain name for your account, you must renew your hosting fee as soon as possible. Domain transfer for any reason, will attract a sum of N2,200 except payment was made initially.

7. Zero Tolerance Spam Policy

We take a zero tolerance stance against sending of unsolicited e-mail, bulk emailing, and spam. Any user who sends out spam will have their account terminated with or without notice.

8. Reseller: Client Responsibility

Resellers are responsible for providing supports to their clients including registering of domain names. VBHOSTNET does not provide support to our Reseller's Clients. If a reseller's client contacts us, we reserve the right to place the client account on hold until the reseller can assume their responsibility for their client. All support requests must be made by the reseller on their clients' behalf for security purposes. Resellers are also responsible for all content stored or transmitted under their reseller account and the actions of their clients'. VBHOSTNET will hold any reseller responsible for any of their clients actions that violate the law or the terms of service.

9. Bandwidth Usage

You are allocated a monthly bandwidth allowance. This allowance varies depending on the hosting package you purchase. Should your account pass the allocated amount we reserve the right to suspend the account until the start of the next allocation, suspend the account until more bandwidth is purchased at an additional fee, suspend the account until you upgrade to a higher level of package, terminate the account and/or charge you an additional fee for the overages. Unused transfer in one month cannot be carried over to the next month.

10. Price Change

VBHOSTNET reserve the right to alter the prices of our products or service at any time in which notice are sent to customers.

11.Changes to the TOS

VBHOSTNET reserve the right to revisit and alter its policies at any time without notice

12. Acceptable Use Policy (AUP)
VBHOSTNET is dedicated to providing top quality service at a very affordable price. The conditions which follow are necessary to ensure that we may continue to provide the best possible service to all of our customers whilst at the same time satisfying our legal and ethical responsibilities.

Failure to follow any condition will be grounds for immediate account deactivation without notice. VBHOSTNET will be the sole arbiter as to what constitutes a violation of any of these provisions.

Activity which results in the suspension or deactivation of an account will result in a forfeiture of all fees paid. Complaints made regarding abuses of an account will be investigated and if found guilty will be grounds for immediate suspension.
